Privacy policy
What data I collect and why
Only what I need for what you ask me.
Today, on this site
- Nothing
- This site has no forms, analytics or cart, and collects none of your data, not even your IP address.
When you write to me or request a consultation
- To reply to you
- Your name and email. Your phone number, if you give it to me.
- To cast your chart
- Your date, time and place of birth.
- To charge you
- Whatever the payment gateway asks for. Your card number goes from your browser to the gateway without passing through me; I only receive confirmation of the payment.
- Your questions and your document
- The questions you send in the form, and the PDF I prepare for you. I use them only to prepare and deliver your consultation and to answer your clarifications.
Your birth details I handle with special care, because they identify a person very precisely.
Your questions may touch on your health, your relationships, your money or your beliefs, which the law considers sensitive data. You decide what to write, and I will never ask you for sensitive data as a condition for helping you.
On what authority I process them
With your prior, express and informed authorization, as required by article 9 of Colombian Law 1581 of 2012. You give it by ticking a box when you request a consultation or write to me.
If you write from the European Union, the United Kingdom or Brazil, the legal basis is also the performance of the contract, because without your birth details there is no consultation, and your consent for everything else.
You can withdraw your authorization whenever you like, at no cost. If you withdraw the details of a consultation that is still in progress, that consultation cannot be prepared.
If you live in the United States: I process your data to provide the consultation you asked for. I do not sell it, share it for targeted advertising or use it for profiling.
How long I keep them
- Emails you send me
- For as long as the conversation lasts and a reasonable time afterwards, in case we pick up the topic again.
- Details of a consultation
- While the consultation is pending, and afterwards whatever Colombian law requires me to keep as support for a commercial transaction.
- Your birth details
- I keep them in case you consult again. If you would rather I didn't, tell me and I will delete them.
- Your questions and your document
- Until the round of clarifications is over; after that, only what Colombian law requires me to keep. If you want me to delete them earlier, tell me.
- Proof of purchase and delivery
- The date of payment, the date I sent your document and the email address I sent it to, without the content, for up to 18 months, so I can answer a payment dispute.
When a piece of data is no longer needed, I delete it. If you ask me to delete it earlier, I do, unless a law requires me to keep it; in that case I tell you which one.
Who else sees your data
I do not sell or hand over your data to anyone, not even for advertising.
I do not use your personal data to train artificial intelligence models, and I do not sell it or use it for targeted advertising.
I use a few technical providers, such as email, the server or the payment gateway. They process your data on my behalf and only see what they need for their function.
Today
- The provider of the mailboxes contacto@astrologiamaosoler.com and consultas@astrologiamaosoler.com, to receive and answer what you write to me.
- If you write to me on WhatsApp, your message goes through WhatsApp (Meta), with servers outside Colombia and under its own terms. If you prefer otherwise, write to me by email.
- Site hosting
- The server where this website lives. It stores nothing of yours.
- My own astrological engine
- I calculate your chart with a program that runs on my own computer. There, your data does not pass through anyone else.
- Artificial intelligence
- Anthropic, PBC (United States), through its API, acting on my behalf. To prepare your reports, my AI astrology system sends it your date, time and place of birth and whatever else the report needs, without your name, email or ID number. For written consultations, I may use it only to translate into English texts I have written, after removing your name, your birth details and anything else that identifies you. Anthropic does not use that data to train its models and deletes it within 30 days at most, unless it must keep it by law or to investigate misuse of its service.
When the site has bookings, payments or analytics, this policy will name each provider, what data it receives and in which country its servers are.
Tracking across websites
This site does not track your activity over time or across other websites, and no third party can collect that kind of information through it. Because there is no such tracking, a browser “Do Not Track” signal has nothing to switch off. If that ever changes, this section will say how I respond to those signals before the change applies.
If you write from outside Colombia
Your data is processed in Colombia, where I am. Colombia does not currently have an adequacy decision from the European Commission.
To prepare your reports, some of your data reaches Anthropic, in the United States, which processes it on my behalf under its data processing agreement. The United States is on the Colombian Superintendence of Industry and Commerce's list of countries with an adequate level of protection. If you write from the European Union, the United Kingdom or Switzerland: the European Commission's adequacy decision for the United States only covers companies certified under the EU-U.S. Data Privacy Framework, and Anthropic is not; so that transfer relies on the European Commission's standard contractual clauses, with their UK and Swiss addenda, included in that agreement. If you are in Brazil, I only make it with your specific consent, which I ask for separately before you buy a report (article 33, VIII, of Brazil's LGPD). If you would like a copy of these safeguards, just ask me.
If in the future I use another provider outside Colombia, this section will say which one, what for and with what safeguard.
What you can ask me for
Wherever you live, you have these rights over your data (article 8 of Law 1581 of 2012 in Colombia, articles 15 to 22 of the European Regulation in Europe and the United Kingdom, article 18 of the LGPD in Brazil):
- To know what data of yours I hold and what I have done with it, free of charge.
- To correct any that is wrong or incomplete.
- To delete it, unless a law requires me to keep it.
- To ask me for proof of the authorization you gave.
- To withdraw that authorization whenever you like.
- To restrict or object to a specific use.
- To take it with you in a format you can reuse.
- To complain to the authority in your country.
To exercise any of them, write to me at contacto@astrologiamaosoler.com and tell me what you need.
If I refuse a request about your data, you can appeal: reply to my answer with the word “Appeal”. I will reply in writing within 60 days, explaining what I did and why. If I still refuse, I will tell you how to complain to the authority where you live; in the United States, that is usually your state’s Attorney General.
How quickly I reply
I apply the Colombian legal deadlines to everyone.
- A query about your data
- Ten business days. If I need more, I will let you know before they run out and reply within five more business days at most.
- A complaint
- Fifteen business days from the day after I receive it. If I need more, I will tell you why and reply within eight more business days at most.
While a complaint is being handled, I mark it as such in my records within two business days at most.
Minors
I work with children and teenagers only with the prior authorization of their father, mother or legal guardian, who is the one who gives me their data. I process that data with the minor's interest in mind, and I take their opinion into account according to their age and maturity.
Without that authorization I do not collect data from minors. If a minor gave me their data without it, write to me and I will delete it.
How I look after them
With restricted access, strong passwords and encrypted connections, and without keeping what is not needed.
If an incident affects your data, I will let you know and report it to the authority.
If this changes
This policy will change when the site adds bookings, payments and analytics. If the change is substantial, such as a new use of your data or a new provider, I will announce it at the top of this page at least 30 days before it applies and, if you have bought a consultation or report from me, I will also tell you by email.
The date of the current version is at the end of this page.
Where to complain
In Colombia, before going to the Superintendence you must have made the complaint to me, as article 16 of Law 1581 requires. Outside Colombia you can write to me first or go directly to the authority in your country.
